已经非常明确的,我们的警察部队已经是成为政治部队!

最近,我们看到了警察部队与总理公署属下的选举局发表联合声明。他们在联合声明里解释为什么要拿走我以及鄞玉林的电脑和手机(见201662日海峡时报)。

令人感兴趣的是,这份联合声明在选举局和内政部的网站上无法找到!

我和鄞玉林将不会是第一个或者最后一个被拿走电子设备的人。在2013年,电影制作者李琳恩(Lynn Lee)在没有搜查令下,她的手机和电脑已经被拿走过了。她在没有被起诉触犯任何的条例下经历这场恐怖的行动的。用不着咋说,她的电脑和手机是报废了。

漫画家Leslie Chew有过同样恐怖的经验。当他在机场被捕时,他被警方关押了几天。他的家被抄家/他的电脑别拿走。我可以肯定他的电脑已经完全报废了。

就在昨天,我听说,警方又到一个博客家拿走了他的电脑。他在警察局耗费忧虑的几小时。他并没有被起诉触犯任何条例。看来,似乎警方已经把拿走他人的电脑和手机成为恐吓和骚扰社会活动分子和博客的有效的手段了。问题是,社会活动者和博客是不是我们的警方唯一的目标呢?

我不知道,假设警方可以在没有搜查令下进入社会活动分子和博客的家里拿走他们个人的物件,那他们对待商人、亿万富翁、个人和旅客有时如何呢?这个星期六在芳林公园举行的聚会将不会仅仅是社会活动分子感到兴趣吧了,必然会引起那些居住在新加坡的每一个人感到兴趣。

警方说,在刑事法典刑事储程序第3435部分的约定下,他们拿走过人的大脑和手机是属于合法的。他们不需要持有任何搜查令。这是他们告诉我的。他们说,“作为调查案件的一个组成部分,警方需要对用于在网上发表帖子的工具电子设备进行检查,以寻找出证据。因此,我们(警方)必须拿走这些电子设备。”

我不接受他们所说的理由。我和鄞玉林都已经承认了我们在冷静日当天在网上发表帖子。我们辩护的理由是,我们行使宪法赋予一个公民表达自由的权力。他们根本不需要拿走我们的手机和电脑,并进行司法鉴定这些设备。警方的行为已经造成了非常恶劣的不便和对我们的电子设备进行任何纂改措施了。他们已经造成我和鄞玉林不得不再购买新的手机 和电脑。

一些朋友告诉我说,我不应该允许警方进入我的家。因为警方根本就没有权利这么做。是的。假设为不开门让他们进来,他们将会使用铁棒撬开大门。在1987年,警方就是破门进入物价,但是,他们找不到任何的颠覆文件或者武器的。他们最后赔偿了衷心安装被破坏的大门。这回,当他们把我押回家里时,我不想再看到同样的情况再一次重覆出现。

我感到非常失望和遗憾,我们的国家陷入了一个目无法纪的国家了。因为警方是应该人民的安全的,但是,现在却被用来保护他们那些目无法纪的行为。

我们是否要继续无所作为让他们这样蹂躏我们的权利直到我们一无所有。

It is clear that our police force has become a political force.

Just recently, we saw the Singapore Police Force and the Election Department of the Prime Minister’s Office issued a joint press statement on why they seized my computers and mobile phones as well as that of Roy Ngerng (see The Straits Times 2.6.2016). Interestingly, the joint press release is not found in the Elections Department or Ministry of Home Affairs websites.

Roy and I were not the first nor will we be the last to have our electronic devices seized. Filmmaker, Lynn Lee had her computers and mobile phone seized without warrant in 2013. She was not charged with any offence at the end of the harrowing exercise. Needless to say, her computers and handphone were rendered useless.

Leslie Chew, our cartoonist, too had a harrowing experience when he was arrested at the airport and spent several days in the police lockup. His home was raided and computers seized. I am sure all his computers were also rendered completely useless.

Just yesterday, I heard that a blogger was suddenly visited by the police at his home and had his computers seized. He spent several anxious hours in the police station. He was not charged with any offence.

It seems that seizure of computers and mobile phones are the favourite method of our police in harassing and intimidating activists and bloggers. But are activists and bloggers the only targets of our police?

I don’t know. If the police can enter houses of activists and bloggers and seize their properties without warrants, what is there to stop them from doing the same with business people, billionaires, workers and tourists? This Saturday’s gathering at our historic Hong Lim Park should therefore be of interest to everyone who resides in Singapore and not just activists.

The police claimed that the seizure of computers and electronic devices are lawful as they are permitted to do so under sections 34 and 35 of the Criminal Procedure Code. No warrants are required, or so they told me. They said: “As part of the investigations, the police need to examine for evidentiary purposes electronic devices used to publish the online postings. As such, these devices had to be seized.”

I disagree with their rationale. Both Roy Ngerng and I had admitted that we were responsible for the postings on Cooling Off Day. Our defence is that we were exercising our constitutional right to freedom of expression. There was no necessity to seize our handphones and computers and forensically go through these devices. The police have caused us terrible inconvenience and have tampered with our devices. Both Roy and I have incurred costs buying new computers and mobile phones.

Some friends had commented that I should not have allowed the police into my flat. as they have no right to do so. Well, if I didn’t open my door, they will use crowbars to break it down. In 1987, police officers broke down my door and found no subversive documents or weapons. They paid for the reinstatement of my door. I saw the violence then and I didn’t want to see a repeat of such violence when they escorted me to my flat this time.

I am sad and disappointed that my country has descended into lawlessness because the very people who are supposed to keep us safe are now using the law to protect their lawless deeds. Do we do nothing and let them trample on our rights till we have nothing left?
